She said “No!”
“No to litigation”—which was especially surprising because, according to Nye, her attorney told her she “had what appeared to be a winnable case.”
So why walk away?
During a recent WCNi News Service interview, Nye explained, “There’s a long list of reasons, including being 78 years old and asking myself: How much of the life I have left am I willing to surrender to litigation—even with favorable odds? None of it!”
“And,” Nye added, “I’m not talking about the financial cost of litigation. I’m talking about costs measured in years, stress, depositions, discovery, hearings, motions, uncertainty—and the emotional burden of repeatedly reliving what has already been lost.”
When asked to explain her “long list” of reasons, Nye produced and read from a prepared list she titled “PAMELA JANE NYE’S TOP 10 REASONS FOR DECIDING NOT TO LITIGATE.”
Nye gave her reasons as follows:
Number 10 — Nye said, “Because lawsuits can consume years, and at age 78, I choose to do better things with those years.”
Number 9 — Nye said, “Because litigation consumes energy. At my age and given my personal circumstances, time and energy are precious resources—and litigation comes with no assurance of a positive result.”
Number 8 — Nye said, “Because I don’t want my life’s schedule controlled by litigation, meaning lawyers, depositions, discovery, hearings, motions, a trial and a foreseeable appeal. I’ve already lost enough time.”
Number 7 — Nye said, “Because I don’t want money to be mistaken for my mission, which isn’t simply about getting money. It’s about what I experienced, what I believe happened—and helping other people avoid having it happen to them.”
Number 6 — Nye said, “Because I don’t need a courtroom to tell my story, and technology has created something that didn’t exist for previous generations: the ability for one ordinary person to put information and evidence directly before millions of interested people.”
Number 5 — Nye said, “Because I’d rather expose a fixable problem than spend years fighting it.”
Number 4 — Nye said, “Because I want people to get involved, learn from my experiences, decide for themselves, then share their opinions.”
Number 3 — Nye said, “Because living well is the best revenge, meaning I don’t want or need to spend the next chapter of my life trying to destroy something. I would rather build something better.”
Number 2 — Nye said, “Because I want the time I have left to be peaceful. Peaceful thoughts. Peaceful experiences. Peaceful results.”
When it came to Nye’s Number 1 reason, she paused, smiled slightly and, with a determined voice, replied:
“BECAUSE I DON’T WANT TO.”
Nye then emphasized, “My deciding against litigation should not be confused with deciding to remain silent. Quite the opposite!”
For Nye, saying “No” to the courtroom means saying “Yes” to something very different: using today’s technology to put her experience, information and questions directly before the public.
